A Policy That Protects Your Privacy

NexTier, Inc. (“NexTier”) and its family of companies are firmly committed to protecting your personal information. Because we value your business and your continued trust, we pledge to use this information in a secure and responsible manner, and only when it is necessary in the course of providing financial products and services to you. We have developed this Privacy Policy to help you understand the types of personal financial information we collect, the measures we take to protect this information, and the manner and extent to which we share this information among the NexTier family of companies and with certain other parties. This Privacy Policy applies to personal information collected or used when we offer financial products or services to you for personal, family or household purposes.

NexTier will collect and use your personal information only when it is necessary in the course of providing financial products or services to you. Examples of the types of information we collect and use are as follows:

  you, such as your account balances and usage, loan information and payment

• Third Party Information. Information about your transactions with other companies regarding employment, credit and other relationships that help us determine eligibility for products you request.

We Limit Access to Information

We restrict access to your personal information to those employees who need to know that information solely for business purposes. We have implemented policies, procedures and training programs that are designed to protect the confidentiality and security of your personal information. Each NexTier employee is required to comply with our customer privacy policies and procedures.

We also maintain physical, electronic and procedural safeguards that comply with federal standards to protect the confidentiality of your personal information.

Information We Share Among NexTier Companies

We share contact information and experience information among NexTier companies in order to
facilitate the provision of banking and other financial products and services that are appropriate for you. We do not share eligibility information or third party information among NexTier companies unless it is necessary to process a transaction that you authorize.

You may limit our ability to share eligibility information and third party information, among NexTier companies. You may also limit our ability to share, for marketing purposes, any personal information with any NexTier company that does not have a pre-existing business
relationship with you. Your choice to limit these marketing offers will apply indefinitely from when
you tell us your choice. We will continue to share contact information and experience information as described above, but such information will not be used by any NexTier company that does not have a pre-existing business relationship with you.

Information We Share Outside of the NexTier Family of Companies

We generally do not share customer information with any third parties that are not affiliated with NexTier. We may, however, share customer information with unaffiliated third parties that perform certain services on our behalf, such as printing checks, preparing and mailing account statements, appraising property offered as collateral and processing customer transactions.

We may also share customer information pursuant to joint marketing arrangements with third party financial institutions that offer certain financial products and services, such as wealth managemet, insurance and securities brokerage. Generally, we only provide contact information (name, address, and telephone numbers) and experience information (account balances and related information). When we offer credit related insurance products, we may provide certain account information that is necessary to process the insurance transaction. We do not provide customer account numbers or eligibility information as part of the joint marketing arrangement. Before sharing customer information with any third party, we require these third partieis to agree, in writing, to maintain the confidentiality and security of our customer information and to use it only as authorized by us.

Finally, we may share customer information with non-affiliated third parties when you consent or request that we share this information or when we are legally permitted or required to share this information. For example, we share information with consumer reporting agencies or with third party merchants to verify your account status. We also share information when we are required to do so by law or pursuant to a court order.

We are not responsible for the collection, use or security of information by non-affiliated companies or organizations that may be linked to our websites. We encourage you to read the privacy policies of websites reached through the links from NexTier websites. Our website may place a small file or cookie on your computer’s hard drive. This file has no confidential information about you personally, but identifies your computer when you return to our site. This is done in order to facilitate the usage of our site and to optimize it for your convenience.

Former Customers

We do not share information about former customers with outside parties, except as permitted or required by law.
